Agreement to Terms

By accessing or using the services provided by Sam's Electronics ("we," "us," "our"), including our website, repair services, TV mounting, and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Our Services

Sam's Electronics offers professional electronics repair, diagnostics, maintenance, and TV mounting/installation services. Specific services include but are not limited to:

• Smartphone, tablet, and laptop repair
• Screen replacement, battery replacement, charging port repair
• Water damage restoration
• Gaming console repair (PlayStation, Xbox, Nintendo Switch)
• TV mounting, wall installation, and cable management
• Diagnostic services and technical consultations
• Smartwatch, e-reader, and headphone repairs

Service Estimates & Pricing

All repair estimates are provided based on initial visual inspection and diagnostic testing. You acknowledge that:

• Estimates are non-binding and may change if additional issues are discovered during repair
• We will obtain your verbal or written approval before performing any work exceeding the original estimate by more than 15%
• Diagnostic fees may apply if you choose not to proceed with the recommended repair
• All prices are in US Dollars and subject to applicable taxes

Device Data & Privacy

You are solely responsible for backing up all data on your device before submitting it for repair. While we take precautions to protect your data, Sam's Electronics is not responsible for:

• Data loss, corruption, or damage that may occur during the repair process
• Loss of personal information, photos, contacts, or any other digital content
• Confidentiality of data stored on devices that are beyond repair

We strongly recommend that you perform a full backup of your device before any service. By using our services, you release us from any liability related to data loss.

Warranty Policy

We stand behind our work with a 120-day limited warranty on repair services and replacement parts. Our warranty covers:

• ✓ Defects in workmanship or parts under normal use
• ✓ Free re-evaluation of any issue related to the original repair

The warranty does NOT cover:

• ✗ Physical damage caused by drops, impacts, or accidents after repair
• ✗ Liquid damage or exposure to moisture after repair
• ✗ Damage caused by unauthorized third-party repairs or modifications
• ✗ Normal wear and tear, cosmetic damage, or batteries (which are consumable items)
• ✗ Software issues, viruses, or user-caused malfunctions

Warranty claims must be presented with original proof of service receipt. Warranty is void if the device has been tampered with or repaired by another party after our service.

TV Mounting & Installation Terms

For TV mounting and wall installation services, the following additional terms apply:

• We will mount your TV on the wall location you designate, provided the wall can safely support the weight
• You are responsible for disclosing any hidden wiring, plumbing, or structural issues in the wall
• We are not liable for pre-existing wall conditions including drywall weakness, water damage, or structural defects
• We will hide cables within conduit or wall channels where possible, but cannot guarantee against future damage
• You must provide a working power outlet near the mounting location
• We are not responsible for removing existing wall mounts or patching previous mounting holes

Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept:

• Cash
• Credit/Debit Cards (Visa, MasterCard, American Express, Discover)
• Digital payments (Apple Pay, Google Pay, PayPal where available)

We reserve the right to require a deposit for high-value repairs or special-order parts. Any deposit is non-refundable once parts have been ordered or work has commenced.

Cancellation & Refund Policy

You may cancel a scheduled service appointment with no penalty up to 2 hours before the scheduled time. For TV mounting appointments, we require 24-hour notice for cancellation. Refund terms:

• If we determine a device is unrepairable and you have not authorized any work, diagnostic fees may apply
• No refunds will be issued for services already performed
• If you are unsatisfied with a repair, we will re-evaluate under our warranty policy
• Refunds for deposits are only available if we cancel the appointment or cannot perform the service

Limitation of Liability

To the fullest extent permitted by law, Sam's Electronics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our services
• Any conduct or content of any third party on our services
• Unauthorized access, use, or alteration of your transmissions or content
• Damage to devices during repair (we will repair any damage caused by our technicians at no cost, but this is our sole liability)

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid us for the specific service giving rise to the claim.

User Responsibilities

As a customer, you agree to:

• Provide accurate and complete information about your device and its issues
• Back up all important data before dropping off your device
• Remove any screen locks, passwords, or security features before service (or provide them in writing)
• Retrieve your device within 30 days of service completion; unclaimed devices may be disposed of or recycled after 60 days
• Pay all applicable fees promptly

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Sam's Electronics or its content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we shall not be liable for any damage or loss caused by or in connection with your use of such third-party content.

Indemnification

You agree to indemnify, defend, and hold harmless Sam's Electronics, its employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any claim that your device caused damage to a third party

Modification of Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Dallas County, Texas.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Sam's Electronics regarding our services and supersede all prior agreements and understandings, whether written or oral.
